Decision in Loper Bright v. Raimondo Undermines Democracy

New York, NY – Roosevelt Institute released the following statement on the Supreme Court’s decision overruling Chevron v. Natural Resources Defense Council, which upended a critical administrative law principle, severely hampering agency powers and further entrenching the power of the courts.

“Throughout the past few decades, conservatives have successfully narrowed Chevron’s scope. Today’s decision is the final step in the reactionary movement’s crusade against Chevron, as the majority overrules the case altogether and strikes a blow to the separation of powers that lie at the heart of American democracy,” said Shahrzad Shams, senior program manager for race and democracy at the Roosevelt Institute. “The Loper Bright/Raimondo decision entrenches the power of the courts while weakening the functionality of administrative agencies. This further opens the door to regulatory capture and corporate disregard for the health, safety, and well-being of people and planet.”
